They ruled: even if the NRA in Japan OKs restart, it is a violation of human rights and not permitted. Kudos to the heroic prosecutors, esp Hiroyuki Kawai who most likely masterminded this !!!!!

Screw the utility companies! Poisoning the entire Earth is unacceptable! "Should the Fukui court’s ruling become the precedent for other courts to follow in the days ahead, many nuclear reactors will be prevented from resuming operations. For power companies, this will obviously be unacceptable."

THIS IS THE SECOND TIME THAT A NUCLEAR PLANT HAS BEEN BLOCKED FROM RESTARTING BY A JUDGE

They are having a very difficult time. Just in recent days again a judge in Fukui prefecture ruled for the second time against the restart of atomic reactors in their prefecture, this time at Takahama. Two reactor units were blocked by this judge’s ruling from restarting. And last year he ruled against two reactors at the Oi nuclear power plant. So the local population, the local governors of prefectures, and local elected officials like mayors have put a stop to these plants restarting reactors in Japan.

As more judges realize that is it THEIR families and kids and property that these nuclear monsters threaten, the easier it will be to convince them that they need to do whatever is necessary to block them from starting up.

GROUP OF 300 LAWYERS INTENDS TO SUE EVERY UTILITY THAT TRIES TO RESTART A NUCLEAR REACTOR IN JAPAN

… the Tokyo-based Liaison Group of Lawyers to Stop Nuclear Power – now said to number about 300 members – is planning to sue every utility in Japan that attempts to return its plants to capacity.

SUMMARY

Although this may seem like a small thing, it is a HUGE victory globally. Any judge across the globe can use this ruling and build on the precedent being set. Operating nuclear power plants is a violation of human rights to informed consent of radiation experiments, and informed consent of nuclear disaster that may result in death and loss of all possessions, health, ability to raise healthy children, ability to work and more.

The other part of this ruling is that the judge focused on the inability of any nuclear plant to meet earthquake standards. In other words, what he was saying was that Fukushima was taken out by an earthquake, despite TEPCO denying this. He ruled that no nuclear plant can be built to withstand a worst case earthquake like the 3/11 earthquake that came in at a level 9.0. 

Any nuclear plant built to a sufficient safety standard to withstand force 9.0 earthquakes and huge tsunamis, would be so expensive that it could not be built, period. This ruling should doom the nuclear energy industry globally if other judges and citizen groups are paying attention, and use it in a similar manner.
