A bombshell report from the Inspector General (IG) at the Department of Justice has exposed the Drug Enforcement Administration (DEA) for the colossal thieves they are. According to the report, DEA seized more than $4 billion in cash from people since 2007, but $3.2 billion of the seizures were never connected to any criminal charges. That figure does not even include the seizure of cars and electronics.

This thievery is possible through the insidious practice of civil asset forfeiture (CAF), where law enforcement can seize cash and property on the mere suspicion of being involved in criminal activity. Originally developed in the 1980s to go after organized crime, CAF has mushroomed into a source of revenue for cops across the country – from local to state to federal – in what’s become known as Policing for Profit.

Even if you are dressed in business suits and can prove the money you carry is for payroll, they can take and keep your money, with no trial, jury or court.

Did you know that cops seize millions worth of cash and property from Californians every year? It's called civil asset forfeiture – it's unfair and must be stopped!

A routine traffic stop on Interstate 5 resulted in CHP taking $18,000 from a small business owner in San Diego – even though she had paperwork that proved the cash was for payroll. Luckily, she was able to hire an attorney and eventually got her money back … nearly two years later. But not everyone can afford to fight the government in court.

Asset forfeiture laws were originally designed to take down drug "kingpins," but they morphed into what amounts to legalized theft by cop. About 20 years ago, California reformed the flawed state laws to protect innocent people, but cops have found a loophole: federal laws.

The California Assembly is about to vote on a bill (SB 443) that would eliminate this loophole and make sure that police can only take and permanently keep someone's money or property if the person is convicted of a crime.

SB 443 is supported by 76 percent of California voters – Republicans and Democrats alike. Now let's make sure the California Legislature gets it right.

Police shouldn't be able to take and keep people's cash and property.

The idea of going at people through their property has a long history. The theories are quite old. The prevalence of the practice is comparatively recent.

Civil forfeiture has a history dating back several hundred years with roots in British maritime law to the British Navigation Acts around the middle 1600s. These laws required ships importing or exporting goods from British ports to fly the British flag; ships which failed to do this could be seized regardless of whether the ship's owner was guilty of doing any wrongdoing.[5] It was easier to seize a vessel than try to apprehend an owner on the other side of the ocean,[6] as explained by Supreme Court justice Joseph Story:

...(A) vessel which commits the aggression is treated as the offender, as the guilty instrument or thing to which the forfeiture attach├ęs, without any reference whatsoever to the character or conduct of the owner. (The seizure of the ship is justified by...) the necessity of the case, as the only adequate means of suppressing the offense or wrong, or insuring an indemnity to the injured party.

During the later Colonial years, forfeiture practices by the Crown officials using writs of assistance were one of the many activities that angered colonists, who saw the writs as "unreasonable searches and seizures" which deprived persons of "life, liberty, or property, without due process."[6] 

Prohibition era


During Prohibition, Detroit police inspect equipment suspected of being used to make alcohol; under civil forfeiture laws, police could seize the equipment without having to charge any owners with a crime.

Government used forfeiture during the Prohibition years 1920-1933.[5] Police seized vehicles and equipment and cash and other property from bootleggers.[4] When Prohibition ended in 1933, much of the forfeiture activity ended as well, and modern forfeiture was an "infrequent resort" until the last few decades.[6]


Prohibition did not work, as the crime rate skyrocketed and corruption just multiplied like cockroaches in a dark moist food rich environment. This is why Prohibition was cancelled and alcohol was 'legalized'.

One of the greatest political philosophers, Frederic Bastiat, wrote that the law should exist to protect life, liberty, and property, but unfortunately is often perverted into a means of “legal plunder.” In other words, the law is used to legitimize the use of force to deprive people of their wealth.

A recent Washington Post article Stop and Seize shines a light on actions by police that perfectly exemplify the sort of abuse Monsieur Bastiat warned about. In it, readers learn how police forces across the country exploit civil asset forfeiture laws to deprive hapless, innocent people of cash and other property.

CORNELL LAW: Forfeiture takes two distinct forms -- criminal and civil. Nearly all contemporary forfeiture involves the civil variety. Criminal forfeiture operates as punishment for a crime. It, therefore, requires a conviction, following which the state takes the assets in question from the criminal. Civil forfeiture rests on the idea (a legal fiction) that the property itself, not the owner, has violated the law. Thus, the proceeding is directed against the res, or the thing involved in some illegal activity specified by statute. Unlike criminal forfeiture, in rem forfeiture does not require a conviction or even an official criminal charge against the owner. This is the source of its attractiveness to law enforcement, and its threat to those concerned about abuse or circumvention of Constitutional protections.

PhilipUpNorth November 19, 2015  Did you know that US Federal Asset Forfeitures are now more than all Property Offences? The US government now steals more money than burglars and robbers do.

"Asset Forfeitures" are supposed to be limited to the confiscation of ill-gotten gains of drug dealers and such, but law enforcement at all levels, from feds down to the village traffic cop, seem to be abusing the situation by going after any and all cash from anybody they can get their hands on.

"That’s $4.5 billion in federal civil asset forfeitures in the U.S. just within 2014. Billion, with a “B”.

"The FBI estimates that, by contrast, all 2014 property offenses totaled approximately $3.9 billion."

But in the bizarro world of Catch 22 in the United States, the police and other authorities are allowed to seize property, homes, cash, cars and more from innocent civilian citizens in the United States, and there is almost nothing a person can do to get that property back. Under the guise of the 'war on drugs', police have become the criminals, and are now robbing US citizens.

Police May Be Seizing Money And Property From Innocent People In America

The Constitution and Bill of Rights do not allow for seizing of property from someone without due process.

In the bizarro world of Catch 22 in the United States, the police and other authorities are allowed to seize property, homes, cash, cars and more from innocent civilian citizens in the United States without a judge, no jury, no trial and with no proof of any crime. 

There is almost nothing a person can do to get that property or money back once the police seize it under anti drug laws. Under the guise of the 'war on drugs', police may have become the criminals, and may now be involved in robbing innocent US citizens. 

No one really knows how big the problem is, and the police are not talking..Of course, if you don't own anything and don't have any cash in your bank accounts or under your mattress, don't worry. 

The war on drugs has been lost according to many experts. It may be time to revoke or repeal the anti Constitutional anti drug laws, just as the Prohibition era laws against alcohol were abolished many years ago.
